4.12 Tobacco, Drug And Alcohol-Free Environment

Amberley OSHC shall ensure the health and safety of persons within Amberley OSHC through the provision of tobacco, drug and alcohol free environment.  This demonstrates a commitment to the health and wellbeing of all who use Amberley OSHC.

Relevant Laws and other Provisions

The laws and other provisions affecting this policy include:

  • Education and Care Services National Law Act, 2010 and Regulations 2011
  • Work Health and Safety Act 2011, and Regulations 2011
  • Family and Child Commission Act 2014
  • Tobacco and Other Smoking Products Act 1998 and Other Smoking Products Amendment Bill 2004
  • NQS Area: 2.1.1; 3.1.2; 7.1.1, 7.1.2; 7.3.5.
  • Policies: 1 – General Health and Safety, 4.4 – Preventative Health and Wellbeing, 8.10 – Employee Orientation and Induction, 9.3 – Communication with Families.

Procedures

Tobacco

  • Smoking is not permitted in any areas utilised by Amberley OSHC;
  • Smoking is not permitted in any open space 10 metres from Amberley OSHC outdoor area or fence line.
  • Staff will not smoke in front of, or in the sight of, children in their care.
  • No persons is allowed to promote cigarette smoking in the workplace, or advertise the fact that they smoke to other staff, children or families.
  • Staff who wish to smoke during work hours may do so outside the workplace and in their scheduled lunch break, or approved breaks.
  • Students, volunteers and visitors to Amberley OSHC will not be permitted to smoke on the premises and will adhere to the Smoke Free Environment Policy.
  • Parents, family members or relatives of children enrolled at Amberley OSHC will not be permitted to smoke on the premises and will adhere to the Smoke Free Environment Policy.
  • Amberley OSHC will support and provide assistance for smokers to quit smoking.
  • Amberley OSHC handbooks shall include information regarding Amberley OSHC’s policy and procedures for smoking.
  • Visitors to Amberley OSHC location or site shall be actively informed as required about the policy and procedures for smoking.
  • Being as the OSHC is on school grounds the school has appropriate no smoking signs

Drugs

  • Illegal drugs are not permitted in any areas utilised by Amberley OSHC.
  • Pharmaceutical drugs and medications may only be bought into Amberley OSHC area with the expressed permission of the Nominated Supervisor.
  • Pharmaceutical drugs and medications may not be taken into any area that may be accessed by the children in care.

Alcohol

  • Alcohol may only be bought into Amberley OSHC with the expressed permission of the Nominated Supervisor.
  • Alcohol may not be taken into any area that may be accessed by the children in care.
  • No staff member may consume alcohol on the premises during licenced operation hours.
